These Terms of Service (“Terms”) are an agreement between you and TrustCert LLC, a Colorado limited liability company (“TrustCert”, “we”, “us”), governing your use of the trustcert.ai website, applications, and related services (collectively, the “Service”). By creating an account or using the Service you agree to these Terms. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” refers to it.
trustcert.ai is an AI-powered compliance intelligence platform. TrustCert acts as a compliance intermediary that helps you research regulatory requirements, certification pathways, and market-access obligations, and manages certification projects through accredited laboratories and certification bodies.
The Service provides informational research assistance only. It is not legal advice, and no attorney-client or consultant-client relationship is created by your use of the Service. Regulatory requirements change frequently; you are responsible for verifying any requirement with the relevant authority or qualified counsel before acting on it.
You must be at least 18 years old and capable of forming a binding contract to use the Service. You agree to provide accurate registration information, to keep your credentials confidential, and to notify us promptly of any unauthorized use of your account. Email verification is required before the Service can be used. You are responsible for all activity under your account.
The Service is intended for one account per person or organization unless we agree otherwise. We may limit the number of free-tier accounts and decline or close accounts created to evade usage limits.
The Service is offered in four tiers: Free, Professional, Intelligence, and Sovereign. Paid subscriptions are billed through our payment processor, Stripe, on a recurring monthly basis and renew automatically unless auto-renew is turned off or the subscription is cancelled. Each tier includes daily usage allowances (credits) and upload limits as described on our pricing page; allowances reset daily and unused allowances do not carry over.
You may cancel at any time from your account or the billing portal. Cancellation takes effect at the end of the current billing period: you keep paid access until then, after which your account moves to the Free tier. Except where required by law, fees already paid are non-refundable; we do not provide prorated refunds for partial billing periods. If you believe you were charged in error, contact us at billing@trustcert.ai and we will review it. We may change prices with advance notice; changes apply from your next billing period.

You retain all rights to the content you submit — messages, documents, images, and audio (“Customer Content”). You grant us a limited license to host and process Customer Content solely to operate and improve the Service, including transmitting it to the AI models that generate responses.
Uploaded files are stored in temporary cloud storage and are automatically deleted approximately 24 hours after upload. Your chat history is retained in your account until you delete it or your account. You are responsible for keeping your own copies of anything you upload.
Responses are generated by large language models grounded in curated regulatory sources. AI output can be incomplete, outdated, or incorrect — including citations to regulations, fees, standards, or authorities. Output is provided “as is” for research purposes; do not rely on it as the sole basis for a compliance, certification, legal, or commercial decision. Quotations and fee estimates generated by the Service are indicative only unless separately confirmed in a signed agreement.
The Service, including its software, design, curated regulatory corpus, and authority registry, is owned by TrustCert or its licensors and is protected by intellectual-property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the Service for your internal business purposes. As between you and TrustCert, you own the output generated for you, to the extent permitted by law.
The Service depends on third-party providers, including trusted cloud infrastructure providers (hosting, authentication, and data storage), third-party AI service providers (AI processing), Stripe (payments), Resend (transactional email), and Google reCAPTCHA Enterprise (abuse prevention). Your use of the Service is also subject to applicable third-party terms. This site is protected by reCAPTCHA Enterprise and the Google Privacy Policy and Terms of Service apply.
THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF OUTPUT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUSTCERT WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, AND OUR AGGREGATE LIABILITY ARISING OUT OF THE SERVICE WILL NOT EXCEED THE AMOUNTS YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
You may stop using the Service and delete your account at any time from your account settings. Deleting your account cancels any active subscription and removes your data as described in our Privacy Policy. We may suspend or terminate your access for breach of these Terms, for legal compliance, or if we discontinue the Service, with notice where practicable. Sections that by their nature should survive termination (including 07, 08, and 10) survive.
We may update these Terms from time to time. For material changes we will give notice — for example by email or an in-product notice — before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-laws rules. You agree that the state and federal courts located in Colorado will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, unless applicable law requires otherwise.
